Who we are
Localised UK Limited is registered in England & Wales with company number 10986401 and its registered office is at Network House Third Avenue, Globe Park, Marlow, Buckinghamshire, United Kingdom, SL7 1EY (VAT ID: XXXX)("Localised").
We are an authorised reseller of David Beckham Eyewear merchandise in the UK.
When you make a purchase from https://davidbeckhameyewear.com/ (the "site") the legal contract is between you and Localised.
Application
These terms and conditions of sale ("Terms of Sale") apply to any purchase you make on the site. By placing an order on the site, you agree to be bound by these Terms of Sale and confirm that you are at least 18 years old (or, if you are not 18 years old, that you have obtained consent from a legal parent or guardian). If you do not agree to these Terms of Sale or you are under 18 years old and do not have consent from a legal parent or guardian, you must not use the site to make a purchase from us.
We may change these Terms of Sale from time to time and you should check them regularly. The date of the last update is shown at the beginning of these Terms of Sale.
Prices
Prices for merchandise available for purchase on the site are presented to you when you place your order. We take care to price products accurately. Although unlikely, it is possible that a pricing error may occur, and we may reject any orders placed that were priced incorrectly. If this occurs, we will notify you promptly.
When you receive an order acknowledgement email, we're busy confirming your order is in stock and all the details are correct. The contract between us doesn't form until we've completed these checks and taken payment, following which you'll receive an order confirmation email.
The total price payable for your order may include any applicable:
- VAT, goods and services or other sales tax chargeable on the sale, and may also include our estimate of import duty, customs clearance fees and other costs likely to be incurred in connection with importing your order (collectively "Import Fees"); and
- shipping and handling fees.
Order pricing totals are guaranteed, meaning the amount you pay will not exceed the price presented on the site and accepted by you when you placed your order.
Our prices don't include any charges made by the payment provider you choose to use (such as PayPal or bank fees).
We accept a variety of payment methods, including major credit cards, PayPal, and other online secure payment platforms. By placing an order with us, you authorise us to charge your payment method for the total amount of the purchase.
If we encounter issues processing your payment, such as declined cards or insufficient funds, we will notify you. We reserve the right to cancel your order if we are unable to successfully process your payment.
All transactions on our site will be processed in Pounds Sterling (£). If you're using a payment method from a country with a different currency, your bank or payment provider may charge you a currency conversion fee. Please refer to your bank's or payment provider's terms and conditions for more information on any fees that may apply.
Product descriptions
We take reasonable care to ensure that all details, descriptions and prices of merchandise appearing on the site are correct. However, the information given on the site at any particular time may not always reflect the position exactly at the moment you place your order.
Images and measurements on the site are for illustrative purposes only. Whilst we do our best to portray products on the site accurately, slight variations may occur. All measurements are approximate and colour representation and reproduction are dependent upon publishing processes and the set-up of the device upon you're using. Size charts are available in the “Size Guides” section of the site. Without prejudice to any other provision in these Terms of Sale, we confirm that the products delivered will be in conformity with the description, type, quantity and quality as stipulated on the site, and in accordance with the order we concluded with you at the time of delivery.
The order process
We aim to make our order process as smooth and straightforward as possible. Below is a step-by-step guide to concluding an order with us:
Select items. Browse our site and choose the items you wish to purchase. Add them to your shopping basket by clicking the corresponding button on the product page.
Review your basket. Review the contents of your basket, and correct any errors; remove unwanted products, and adjust quantities and sizes.
Checkout. Proceed to checkout by clicking the corresponding button. Then, you will be prompted to enter a payment method. You should review all checkout information carefully to make sure it is accurate.
Accept these Terms of Sale. Before finalising your purchase, you will be asked to review and accept these Terms of Sale.
Confirming your order. Next, you will be asked to confirm your order. This action constitutes an offer to enter into a contract with a payment obligation with us.
Payment. Once we take your payment using your chosen payment method, your contract with us is formed.
Order confirmation. Once you have placed an order, we will send an order confirmation email with the details of your order and shipping details.
We are not obliged to accept your order and may decline your order for any reason. We will notify you by email if we are unable to accept your order (for example, if we can't deliver to your address).
Title to merchandise
Title (by which we mean ownership in legal language!) to the merchandise you purchase via the site will transfer from Localised to you in the UK] at the time the relevant parcel(s) containing some or all of the merchandise you ordered are tendered to the relevant carrier and in that carrier's custody or care to be delivered to you. The transfer of ownership to you needs to happen in this way so we can make sure all of the international taxes, import duties and shipping charges are dealt with in the way we agreed when you placed your order.
Delivery
All dates quoted for delivery are estimated delivery dates only, may be subject to change and cannot be guaranteed. We do not accept liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.
The place and (estimated) time of delivery, shipping method and any applicable fees are as described on the checkout page and the order confirmation which we will email to you after your purchase.
We work with delivery partners (carriers) to ensure your order reaches you. If you select a specific delivery partner, we aim to ensure that your order is delivered by them, however it is sometimes necessary to change which delivery carrier will deliver your order without notice to you. You will receive an email once your order is dispatched with details of the delivery carrier, and any applicable tracking information.
Shipping and importation
If you place an order that requires us to facilitate the import of one or more products to your delivery address:
- you are the importer of record for any products you purchase, and you are responsible for ensuring that your use and import of the products complies with any and all applicable laws and regulations;
- you acknowledge that your order may be subject to import duties and taxes, you will be responsible for paying these charges in accordance with any instructions you receive from us, the delivery company or another third party;
- you authorize a licensed customs broker chosen by us to act as your agent and to deal with foreign revenue authorities to clear your merchandise, account for duties and taxes on your behalf, return your merchandise, and if applicable, prepare and submit refund claims on your behalf for any merchandise that you return;
- we may give you the option to not include our estimate of Import Fees in your order price total. If we provide this option and you choose to make your purchase exclusive of such Import Fees, you agree and acknowledge that the actual Import Fees may be more or less than any estimate appearing on the site, and that you are responsible for paying any and all actual Import Fees levied by the shipper or customs broker to facilitate the import of one or more goods to satisfy your order and procure delivery of such products to your delivery address and we are not responsible for this; and
- you agree that any purchases you make from the site are strictly for non-commercial use, and that you are not permitted to resell any merchandise. Further, by purchasing from the site you confirm that the items you are purchasing via the site will not be re-exported, sold, or transferred in violation of any applicable laws.
Legal stuff
Statutory rights. Your mandatory legal rights are not affected by these Terms of Sale.
Breach of these Terms of Sale. We do not exclude or limit our liability to you if it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud, or breach of your mandatory consumer rights.
We only supply products and services for domestic and private use; consequently, we do not accept liability to you for any loss of profit, loss of business, loss of earnings, business interruption, or loss of business opportunity.
If we don't follow these Terms of Sale, then we'll be responsible for the part of any foreseeable loss or damage that you suffered that was caused by us. In addition, even if we don't follow these Terms of Sale, we won't be responsible for any loss or damage that isn't foreseeable. When we say "foreseeable", we mean that:
- it was obvious that it would happen; or
- at the time we made this agreement, we and you both knew that it might happen.
Our use of your data. We recommend that you read our Privacy Policy, which explains how and why we use your data, and your legal rights.
Applicable law. These Terms of Sale are governed by the laws of England and Wales and. The courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
Right of Withdrawal. You can withdraw from your purchase within 14 days of receiving your order without providing a reason. To exercise your right of withdrawal, simply contact our customer service team at cs@localised.com., visit the returns section of this site, or complete the model form attached as Annex A to these Terms of Sale within the 14-day withdrawal period, notifying us of your intention to exercise your right of withdrawal. To exercise your right of withdrawal, you must return your items to us within 14 days from the moment you notify us of your intention to withdraw. Please ensure that the items are in their original condition, including all packaging. We'll process your refund within 14 days after you inform us of your withdrawal from the purchase, or if we have not yet received the purchase, upon receival of either the items or evidence of return. Your refund will include the full purchase price and any standard shipping fees you paid when placing the order. We will not refund any additional shipping fees above the standard shipping fees which you explicitly opted for, such as next day delivery. The refund will be made in the manner in which the original purchase was made. You will bear the costs of returning the items. Please note that certain items, such as underwear, and swimsuits or bikini bottoms where the hygienic liner is removed, are excluded from the right of withdrawal. If there appears to be fraud or abuse, we may refuse or delay your return.
Complaints and Dispute Resolution
We strive to provide exceptional products and services to our customers, however we understand that things can go wrong. If you have any complaints about your purchase, please contact our customer services team by email at cs@localised.com.. If your complaint cannot be resolved by our customer service team, it may be escalated. We're committed to working with you to find a fair and reasonable solution to any issues that may arise.
We may decide not to participate in any consumer resolution proceedings before a consumer arbitration board and may choose not to participate in any online dispute resolution proceedings.
